Interesting posting after yesterday's court ruling.  Will video description 
survive?  Damn right it will and all who care about it will need to work 
with ACB to make it happen.

on TV.

Hi Charles,

Hmmm, well, I doubt that simply because the entertainment industry is not
being forced to provide audio description that means in any way that the
future of voluntary audio description is in jeopardy.  I'm certain projects
like DVS would certainly continue as they are now; I do sure wish more
titles were available!

You know, I think celebrities should apply some pressure on the rest of the
industry to provide greater audio description for the movies in which they
star.  I mean, most already have a rather lengthy liberal record.  How about
instead of supporting un-American institutions such as terrorists and
corrupted charities, they support blind Americans?

This wouldn't be the new NFB strategy now, would it? I thought NFB's problem was described entertainment was
inappropriate for blind people. Instead, we're supposed to have news and educational matter. Am I wrong?

Subject: [webwatch] Court Vacates FCC Order of Video Description

As some likely know a bit ago the FCC passed an order mandating some network
broadcasts include video description.  The order was appealed and today the
court ruled.  The full ruling is at

The heart of the ruling said:

By its terms, the Act does not provide the FCC with the authority to enact
video description rules. Contrary to the FCC's arguments suggesting
otherwise,
§ 1, 47 U.S.C. § 151, does not give the FCC unlimited authority to act as it
sees fit with respect to all aspects of television transmissions, without
regard to the scope of the proposed regulations. We hold that where, as in
this case, the FCC promulgates regulations that significantly implicate
program
content, § 1 is not a source of authority. Because the FCC can point to no
other statutory authority, the video description regulations must be
vacated.
Accordingly, MPAA's petition for review is hereby granted. NFB's petition
for review is dismissed as moot, because the regulations to which they
object
will be vacated pursuant to the court's judgment in this case.

Hi:

Well, this is a shame.  I'm really at a loss as to where the effort goes
from here.  If this were in Australia, I'm confident we'd be able to use
our antidiscrimination legislation to get something done about it.  But the
ADA sounds like it only applies to so-called "public accommodations" and
I'm not confident that TV would be covered.

This concerns me because a vast amount of TV programs come from the US and
when we eventually get described TV here, material that's already available
will surely have an impact on how much we get to hear.

This subject will be discussed on Blind LIne on ACB Radio Mainstream on
Sunday at 20 hours GMT, that's 3Pm Eastern, noon Pacific and 6Am Monday
morning for poor old me here in Brisbane.

You make good points.  Maybe the industry will now do it voluntarilly, but 
if not; we will be in Congress next.  The only problem with all of this is 
that the industry did nothing for 15 years and we hope our having jump 
started the system will now keep the car going.
